Legally, it refers to expenses incurred by one of many creditors of the same debtor for the common benefit of all creditors (Civil Code, Article 307). For example, it would be the expenses incurred in interrupting the prescription of the creditor's debt, adjusting the asset inventory to clarify the asset content, or carrying out compulsory execution. If one creditor incurs common expenses, other creditors also benefit from the expenditure, so they can receive preferential repayment under the general preferential right (Civil Code, Article 306).

法律上、同一の債務者に対する多数の債権者のうちある者が、総債権者の共同の利益のために費した費用をいう(民法307条)。たとえば、債権者の債務について時効を中断し、財産内容を明確にするために財産目録を調整し、あるいは強制執行をする場合の費用がこれにあたる。債権者の1人が共益費を支出した場合、その支出によって他の債権者も利益を受けるから、一般の先取(さきどり)特権によって優先弁済を受けることができる(同法306条)。
