If an expert witness does not respond to a summons without a valid reason, they will be subject to sanctions such as fines. When conducting an appraisal, the expert witness must also read an oath to the effect that they will "provide an appraisal in good faith and in accordance with their conscience," and submit the results of their appraisal in writing. In addition to court orders, the prosecutor may also request an appraisal for the purposes of an investigation. With the permission of the court, expert witnesses can carry out physical examinations, autopsies, and destroy property.

訴訟事件の審判手続の際に、裁判所の証拠調べで特別の学識経験ある第三者の意見を徴して、裁判官の知識判断能力の補いとするための第三者を鑑定人と称する。鑑定人は、正当の理由がなくて呼出しに応じないと過料などの制裁を受ける。また鑑定人は、鑑定に際しては、「良心に従い誠実に鑑定をする」旨の宣誓書を朗読し、鑑定結果を書面で提出する。なお、裁判所が命じる以外に、検察官が捜査のために鑑定を嘱託することもある。鑑定人は裁判所の許可によって身体検査、死体解剖、物件破壊などをすることができる。
