Land exchange disposal - Kanchishobun

In the public land exchange system, this refers to a disposition in which a person who has ownership or other rights to the previous land (residential or agricultural land) is assigned land (residential or agricultural land) specified in a land exchange plan in place of the previous land, and the land is ultimately vested in the person. This is carried out by notifying the relevant rights holders of the relevant matters specified in the land exchange plan. When a land exchange disposition is publicly announced, the exchange land specified in the land exchange plan will be considered the previous land from the day after the announcement. In other words, the ownership of the previous land will exist on the exchange land from that time, and all leasehold rights, surface rights, mortgages, and disposal restrictions on the previous land will also exist on the exchange land. On the other hand, the rights existing on the previous land that was not specified in the land exchange plan will be extinguished on the day the announcement is made.

公用換地制度において、従前の土地（宅地または農地）について所有権その他の権利を有する者に対し、従前の土地にかえ、換地計画で定められた土地（宅地または農地）を割り当て、終局的にこれを帰属させる処分をいう。関係権利者に、換地計画において定められた関係事項を通知して行われる。換地処分の公告があったときは、換地計画において定められた換地は、その公告のあった日の翌日から従前の土地とみなされる。すなわち、従前の土地の所有権がそのときから換地の上に存することになるほか、従前の土地上の賃借権、地上権、抵当権、または処分の制限はすべて換地の上に存することになる。他方、換地計画において換地を定められなかった従前の土地に存する権利は、その公告があった日が終了した日において消滅する。
