Under the Prison Law (1908), this term referred to facilities that detain those who have been sentenced to a prison sentence (imprisonment, incarceration, detention), criminal defendants, suspects, and those sentenced to death. The Prison Law was drastically revised in 2005 by the Prisoner Treatment Law, which abolished the term "prison" and replaced it with "penal institutions." Under the old law, prisons were divided into four types: penal servitude prisons, incarceration prisons, detention houses, and detention prisons for detaining criminal defendants and those on death row. 監獄法（1908年）のもとで，自由刑（懲役・禁錮・拘留）に処せられた者，刑事被告人，被疑者，死刑の言渡しを受けた者を拘禁する施設を指した用語。2005年制定の〈受刑者処遇法〉により，監獄法は抜本的に改正され，監獄という呼称も廃されて，〈刑事施設〉と改められた。旧法のもとでの監獄は，懲役監，禁錮監，拘留場と，刑事被告人・死刑確定者等を拘禁する拘置監の４種に区分される。また，行政官署としての監獄は，刑務所，少年刑務所，拘置所に分かれる。→代用監獄
