Division of family property - Kasanbunkatsu

Japanese: 家産分割 - かさんぶんかつ

In China from the Han dynasty to recent times, this was a major legal act to dissolve the "family common property" system, and was called "branching the family" or "division." The division was mainly carried out at the will of the father while he was alive, or among his children after his death, with equal division between brothers being the general rule, based on the same idea as equality between brothers in religious rites. Unmarried women were only given a small share of their dowry. The division of family property also included an element of inheritance, and there was no inheritance that conflicted with the division of family property.

漢代頃から近時までの中国において，「同居共財」 (家族共産制) を解消するための重大な法律行為であり，「分家」，「分析」などといった。分割は，おもに家父生存中その意思によって行われる場合と，死後，子たる兄弟の間で行われる場合とがあり，兄弟均分が大原則であって，祭祀における兄弟平等と同じ理念に立つ。未婚女子は，若干の持参財産を分与されたにとどまる。家産分割は，同時に相続の要素を含み，家産分割と対立する遺産相続は存在しなかった。
