These are children whose father-child relationship is not presumed under Article 772 of the Civil Code, but is presumed to be legitimate for some other reason. In order to deny the legitimacy of such children, a lawsuit for confirmation of non-existence of parent-child relationship must be filed. If a man and woman who were in a common-law marriage conceive a child and hastily register their marriage, but the child is born within 200 days of the registration, precedent has determined that the child is a "child not presumed to be legitimate."
