Termination compensation - Uchikirihosho
When an employee is injured or falls ill due to work-related reasons, the employer is responsible for providing the necessary compensation (medical compensation) until the employee is fully recovered. In contrast, "termination compensation" is an exemption measure stipulated in Article 81 of the Labor Standards Act with the aim of reducing the burden on employers. This is a system in which, only if the injury or illness has not been cured even after three years have passed since the start of treatment, the employer is exempt from all compensation liability under the Labor Standards Act, provided that the employer pays termination compensation equivalent to 1,200 days of the employee's average wage.

業務上の事由で従業員が負傷したり病気になったりした場合、使用者は従業員に対して全治するまで必要な補償(療養補償)を行う責任を有します。「打切補償」とはこれに対し、労働基準法81条が、使用者負担を軽減する趣旨で規定している免責措置。療養開始後3年を経過しても、負傷または疾病が治らない場合に限り、使用者が平均賃金の1200日分の打切補償を支払うことを条件に、以後の労基法に基づくすべての補償責任を免れる制度をいいます。
