Incoterms - Incoterms (English)

These are rules established by the International Chamber of Commerce to unify the interpretation of typical trade terms used in international sales contracts, such as CIF (cost insurance and freight) and FOB (free on board). In the current international society, legal order is maintained at the national level, and unified laws have hardly been formed. In order to eliminate the inconvenience that arises from this, these rules stipulate unified rules for the interpretation of nine major contract terms based on international practice. Established in 1936, they were revised in 1967, 1976, 1980, and 1990, and became "Incoterms 2000" in the 1999 revision. Since these are not laws but a kind of general terms, they become part of trade contracts when adopted by the contracting parties.

国際的売買契約において利用されている典型的な貿易条件、たとえば、CIF（cost insurance and freight、運賃保険料込渡し条件）、FOB（free on board、本船渡し条件）などの貿易用語の解釈を統一するため、国際商業会議所によって制定された規則。現在の国際社会では法秩序は国家単位に維持されており、統一法はほとんど形成されていない。そこから生ずる不都合を除去するため、主要な九つの契約条件について、国際慣行を基礎として、統一的な解釈の規則を定めたものである。1936年に制定され、以後67年、76年、80年、90年の改訂に続き、99年の改訂で「インコタームズ2000」となった。これは法律ではなく一種の普通約款であるから、契約当事者によって援用されることによって、貿易契約の一部となることになる。
