Ichirin Incident

In this case, the defendant, a tobacco farmer, was charged with violating the old Tobacco Monopoly Law by chopping up and consuming 7 minutes (2.6g) of tobacco leaves, which were to be paid to the government under the law, and costing 1 rin. On October 11, 1910, the Supreme Court overturned the guilty verdict of the original trial and acquitted the defendant. The Supreme Court ruled that the interpretation of criminal laws should be based not only on concepts of physics but also on concepts of social community life, and that minor illegal acts should not be punishable unless there are special cases in which the perpetrator is deemed to be dangerous. This ruling is considered to be the origin of today's theory of punitive illegality.

たばこ耕作者である被告人が，旧たばこ専売法により政府に納付すべき葉たばこ7分 (2.6g) ，価格にして1厘のものを手刻みにして消費し，同法違反に問われた事件。大審院は 1910年 10月 11日，原審の有罪判決をくつがえし，無罪を言い渡した。大審院は，刑罰法規の解釈は単に物理学上の観念だけによらず社会共同生活上の観念を標準とすべきで，零細な違法行為は，犯人に危険性があると認められる特殊な場合でないかぎり不可罰とすべきであるとしたのである。この判決は今日の可罰的違法性の理論の原点であるとされている。
