Yellow Dog Contract

...A contract between labor and management that requires, as a condition of employment, that an employee who is already a member of a labor union will withdraw from the union, and that, if not yet, will not join in the future. It is usually concluded at the request of the employer at the time of employment, and includes a promise to fire the employee if the employee violates this. Since it aims to preclude and hinder the formation of a union, the Labor Union Law prohibits the conclusion of such a contract as an unfair labor practice (Article 7, item 1). In theory, other contracts that restrict union activities, such as those that require an employee not to form a union or, if he or she does join a union, not to actively participate in union activities, are also considered yellow dog contracts. ...
