Objection - Igimoshitate

A type of appeal against an administrative agency regarding illegal or unjust dispositions or other actions that involve the exercise of public power. It refers to an appeal against the administrative agency that made the disposition or the administrative agency involved in the inaction, and is the opposite of a request for review, which is made against other administrative agencies. In principle, an objection is filed when the dispositional agency does not have a higher administrative agency, and a request for review is filed when there is a higher administrative agency.

There are various detailed procedural restrictions, such as the requirement that an objection must be filed within 60 days from the day following the day on which the disposition was discovered, as stipulated in the Administrative Appeal Act (Act No. 160 of 1962).

行政庁の違法または不当な処分その他公権力の行使にあたる行為に関し行政庁に対してなす不服申立ての一種。処分をした行政庁または不作為にかかわる行政庁に対してなすものをいい、それ以外の行政庁に対してなす審査請求の対概念である。処分庁に上級行政庁がないときは異議申立て、上級行政庁があるときは審査請求をするのが原則である。

　異議申立ては、処分があったことを知った日の翌日から起算して60日以内にしなければならないなど、種々細かい手続上の制約がある。これは行政不服審査法（昭和37年法律160号）に定められている。
