…Romanists were the original bearers of historical jurisprudence, bringing about a legal positivist “Pandecten jurisprudence” and a dogmatic study of Roman law using modern concepts and systems. However, after the 1880s, when Pandecten jurisprudence reached near completion, Roman law studies began to be liberated from their service to legal hermeneutics. The study of “interpolatio” (the revisions and changes made to the original text when it was included in the Corpus Juris Juris) and the concept of ancient legal history that extended beyond Roman law to Egyptian, Greek, Babylonian, etc., relativized the value of Roman legal culture, and Roman law (ancient law) studies were purified as history. Nevertheless, in legal education, it continued to be positioned as an introduction to current law (the genealogical history of positive law systems and regulations) for a long time. …
