It is also called the obligation to work. The Constitution stipulates that "All people shall have the right and the obligation to work" (Article 27, Clause 1). Just as the right to work does not mean that people have a specific claim against the state, the obligation to work here does not give rise to a right to demand that the state or people work. The Constitution prohibits the legal forcing of people to work, except in special cases (Article 18). The obligation to work reaffirms that people have a responsibility to maintain the rights guaranteed by the Constitution (Article 12), and at the same time, it is interpreted as a kind of mental provision that people should work as much as possible. 勤労の義務ともいう。憲法は〈すべて国民は勤労の権利を有し,義務を負う〉(27条1項)と定める。労働権が国民の国に対する具体的な請求権を意味するものではないのと同様に,ここでいう労働の義務は,それによって国に,国民に対して,働くことを請求する権利が生ずるといったものではない。労働することを法律で強制することは特別の場合を除き憲法で禁止されている(18条)。そこで労働の義務とは国民が憲法で保障された権利を保持する責任があること(12条)を再確認したものであると同時に,人はすべからく働くべきであるという一種の精神規定と解される。
