Usufruct - servitude
A limited real right (other real right) that allows one to use and profit from the land of others for a certain purpose. There are surface rights, emphyteusis, easements, and common rights. Among the contents of ownership, the right to use and profit from the property, that is, the right to control the use value, is a real right independent of ownership. It is opposed to a security right, which is a real right that controls the exchange value. Usufruct rights are generally established by contract with the owner, but they can also be acquired initially by prescription (Civil Code Articles 163 and 283). They will expire when the period specified in the establishing contract expires, or by prescription as a result of non-exercise, or when the right becomes vested in the owner.

一定の目的のため他人の土地を使用,収益できる制限物権 (他物権) 。地上権,永小作権,地役権および入会権がある。所有権の内容のうち,所有物の使用収益をする権能,つまり,使用価値を支配する権能が所有権とは独立の物権とされたもの。交換価値を支配する物権である担保物権に対する。用益物権は,所有権者との契約により設定されるのが原則であるが,時効により原始的に取得される場合もありうる (民法 163,283) 。設定契約により定められた期間の満了,または不行使の結果時効により消滅するほか,この権利が所有権者に帰属したときは消滅する。
