Yuki Family Law - Yukike Hatto

This is a family law enacted in 1556 (Kōji 2) by Masakatsu Yūki, lord of Yūki Castle in Shimōsa Province (Yūki City, Ibaraki Prefecture). It is also called the Yūki clan's new law, as the word "new law" appears in the text. A copy of the book owned by Matsudaira Motonori, a descendant of the Yūki clan, was destroyed in fires during World War II, but a photocopy is available at the Historiographical Institute of the University of Tokyo. It consists of a preamble, 104 articles, three additional articles, and a petition signed by vassals, and is comparable in both quality and quantity to the "Jinkaishu" (Collection of Garbage) of the Date clan. It is a representative example of the laws of a warring nation. Its contents are wide-ranging, including personal regulations for vassals, merchants, and servants, criminal and civil lawsuits and court procedures, and control of the territory, but it contains many provisions related to controlling the household, especially in the midst of a tense military situation. The most distinctive feature of this law is that it was limited to only members of the household, and its scope was almost entirely restricted to the Yuki Castle territory.

下総(しもうさ)国結城(茨城県結城市)城主結城政勝(まさかつ)が1556年(弘治2)に制定した家法。本文中に「新法度」とみえるので結城氏新法度ともいう。結城氏の末裔(まつえい)松平基則(もとのり)所蔵の写本一巻は第二次世界大戦の戦火で焼失したが、東京大学史料編纂(へんさん)所にその影写本がある。前文、本文104条、追加3条、家臣連署請文(うけぶみ)からなり、質量ともに伊達(だて)氏の「塵芥(じんかい)集」に比肩される。戦国家法の代表である。内容は家臣、商人、下人などについての人身規定、刑事・民事の訴訟・裁判手続、領内支配など多岐にわたるが、とくに緊迫した軍事状況のなかでの家中統制に関する規定が多い。この法度は規制対象が家中に限定され、適用範囲もほぼ結城城領に限られている点に最大の特色がある。
