Madrid Agreement

Japanese: マドリード協定 - マドリードきょうてい

It is the abbreviation for the Madrid Agreement for the Suppression of False or Misleading Indications of Origin, which was established in Madrid in 1891, and is a special agreement of the Paris Convention for the Protection of Industrial Property. Initially, only a few European countries such as France and Spain were parties to the treaty, but now more than 30 countries are members, including Japan, which joined in 1953. This treaty prohibits the use of false or misleading indications of origin, allows for the seizure of imports, and prohibits unfair competition in international trade.

1891年にマドリードで成立した〈虚偽の又は誤認を生じさせる原産地表示の防止に関するマドリード協定〉の略称で，〈工業所有権保護に関するパリ条約〉の特別取極である。当初はフランスやスペイン等のヨーロッパの少数の国のみが加入する条約であったが，現在では30ヵ国以上が加盟しており，日本も1953年に加盟した。この条約により，原産地の虚偽または誤認を生じさせるような表示の使用は禁止され，また輸入を差し押さえられ，国際取引における不正競争行為は禁止されている。
