A person who has died unnaturally, such as from illness or old age, and is suspected of having died as a result of a crime. For example, a body found on the street early in the morning falls into this category. When there is an unnatural death or a body suspected of unnatural death (a body suspected of both unnatural death and criminal death), the public prosecutor must perform an autopsy (see the entry on "autopsy") (Article 229 of the Code of Criminal Procedure). A person who discovers a person who has died unnaturally is not obligated to report it, unless the place is a place that the person occupied. However, he or she is prohibited from arbitrarily changing the scene of the body (Article 1, No. 19 of the Minor Offenses Act) or burying a person who has died unnaturally without an autopsy (Article 192 of the Penal Code. 病死,老衰死などの自然死でない不自然死を遂げた者で,犯罪によって死亡した疑いのある者。例えば,早朝,路上で発見された死体などが,これに当たる。変死者または変死の疑いのある死体(不自然死の疑いがあり,かつ犯罪による死亡の疑いのある死体をいう)があるときは,検察官は,検視(〈検死〉の項参照)をしなければならない(刑事訴訟法229条)。変死者を発見した者は,その場所が自己の占有する場所である場合を除き,届出の義務は負わないが,みだりに死体の現場を変えたり(軽犯罪法1条19号),検視を経ずに変死者を葬ること(刑法192条。
