Subpoena for documents -
In the evidence gathering procedure of a civil lawsuit, a court order is issued to a person who has evidence to submit it. The new Civil Procedure Code enacted in 1996 included an explicit expansion of the obligation to submit documents, the scope of which had previously been disputed (Article 219 et seq. of the same law). Documents related to the professional secrets of public officials are, in principle, to be made public under the Information Disclosure Law (enacted in 1999).

民事訴訟の証拠収集手続において,証拠の所持者に対してその提出を命ずる裁判所の命令。1996年制定の新民事訴訟法によって,従来その範囲について争いのあった文書提出義務の明文的な拡大を含む整備がなされた(同法219条以下)。公務員の職務上の秘密に関する文書については,情報公開法(1999年成立)によって原則として公開することとなった。
