A jurisprudence that has pragmatist philosophy as its common foundation for legal thought. In terms of the history of legal thought, it belongs to the lineage of British utilitarian jurisprudence. It began with O. Holmes, passed through B. Cardozo, and was systematized by R. Pound. It understands law as a means of social control, and holds that law has a regulating function of satisfying as many human desires as possible with the least possible sacrifices. Pound viewed jurisprudence, which should promote human happiness and contribute to the progress and improvement of society, as "social engineering," and conceived of a sociological jurisprudence that applies sociological awareness.
