Support - Fuyou

Japanese: 扶養 - ふよう

Assistance for those who cannot support themselves (→ public assistance). The Japanese Civil Code has a chapter on support, which imposes a mutual obligation to support those who are in a certain kinship relationship (private support system, Articles 752 and 877). In essence, there is an obligation to support and raise between husband and wife and between parents and minor children, but in addition, direct blood relatives and siblings (Article 877, paragraph 1), and relatives within the third degree of kinship may be obligated to support each other in need by a family court ruling only when there are special circumstances (paragraph 2). If a person in need of support cannot reach an agreement with a person obligated to support them regarding the method and level of support, they may request a ruling from the family court. The same applies when there are several persons obligated to support each other and they cannot reach an agreement regarding who will be responsible for support and the burden of support.

自分の力だけでは生活を維持できない者に対する生活上の援助 (→公的扶助 ) 。日本の民法は扶養の章を設けて，一定の親族関係にある者の相互間に扶養義務を負わせている (私的扶養制度。 752，877条) 。夫婦間および親と未成熟の子の間には，その本質上，扶助，養育の義務があるが，このほか直系血族および兄弟姉妹間には当然に (877条1項) ，また3親等内の親族間には特別の事情があるときに限り，家庭裁判所の審判によって互いに困窮した者の生活を扶助する義務が負わされる (2項) 。要扶養者は扶養義務者との間に扶養の方法，程度について協議がととのわない場合は，家庭裁判所の審判を求めることができる。数人の扶養義務者があるとき，相互間で扶養の担当者やその負担について協議がととのわない場合も同様である。
