Japanese: 違法収集証拠 - いほうしゅうしゅうしょうこ

Evidence collected or obtained by illegal means or methods in legal proceedings. Traditionally, its admissibility has been an issue mainly in relation to criminal proceedings. In a narrow sense, it refers to evidence obtained as a result of illegal searches and seizures, but in a broader sense, it is used as a general concept that also includes confessions obtained as a result of illegal detention or interrogation of a suspect, and conversations recorded by illegal wiretapping. In the case of evidence, even if the collection procedure is illegal, it does not change the content or nature of the evidence itself, so there is no doubt that such evidence is useful from the perspective of uncovering the truth in criminal proceedings, that is, ensuring the punishment of the perpetrator.

訴訟手続上違法な手段･方法により収集ないし獲得された証拠。従来，おもに刑事訴訟との関係で，その証拠能力が問題とされてきた。狭義には，とくに違法な捜索･押収等の結果得られた証拠物を指すが，広義には，このほか違法な被疑者の身柄拘束や取調べの結果獲得された自白，違法な盗聴により録取された人の会話などをも含む一般的概念として用いられる。　証拠物の場合，その収集手続に違法があっても，証拠それ自体の内容や性質に変化をきたすわけではないから，刑事訴訟における真実の究明，すなわち犯人の確実な処罰という観点からは，そのような証拠も有用であることは間違いない。
