Administrative Agreement under Article III of the Security Treaty between Japan and the United States of America
An agreement between the governments of Japan and the United States based on Article 3 of the old Japan-US Security Treaty to determine the conditions for the deployment of US forces in and around Japan. It was signed on February 28, 1952, and came into force on April 28, 1952, at the same time as the old Security Treaty. The agreement, consisting of a preamble, 29 articles, and a coda, specified in detail the status and authority of the US military in Japan, but it had many problems, including (1) a strict personal jurisdiction was adopted, particularly with regard to criminal jurisdiction, and no jurisdiction was granted to the Japanese side over US military personnel, civilian employees, and their families, and (2) although it included important content related to the rights and obligations of citizens, it was an agreement between the executive branches without going through the process of Diet approval. Under the new Security Treaty revised in 1960, the name was changed to the Japan-US Status of Forces Agreement, signed on January 19, 1960, and came into force at the same time as the new Security Treaty on June 23 of the same year.

旧日米安全保障条約第3条に基づきアメリカ軍の日本国内およびその付近における配備の条件を定めるため,日本,アメリカ両国の政府間で取決められた協定。 1952年2月 28日調印,4月 28日旧安全保障条約と同時に発効した。協定は,前文,本文 29ヵ条および末文から成り,日本におけるアメリカ軍の地位および権能を詳細に規定したが,(1) 特に刑事裁判権について徹底した属人主義がとられ,アメリカ軍の将兵,軍属およびその家族については日本側にまったく裁判権が認められなかったこと,(2) 国民の権利,義務に関連する重要な内容を含みながら,国会承認の手続を経ない行政府間の取決めとされたことなど多くの問題点を含んでいた。 60年に改訂された新安全保障条約のもとでは,日米地位協定と名称を変え,60年1月 19日調印,同年6月 23日新安全保障条約と同時に発効した。
