The principle of party autonomy, or autonomy of will, in private international law is that the determination of the governing law of an international credit contract is left to the will of the parties, and the law chosen or designated by the parties shall be the governing law of the contract. Because it uses the subjective will of the parties as the linking point, it is called subjectivism, as opposed to objectivism, which uses the place of contract conclusion as the linking point. This principle developed in the 19th century under the influence of the principle of private autonomy in modern civil law, but its origins can also be found in European academic theories and case law from before the 19th century. 国際的な債権契約の準拠法の決定を当事者の意思にゆだね,当事者が選択・指定した法を契約の準拠法とする,との原則が,国際私法上の当事者自治の原則,あるいは意思自治の原則である。当事者の主観的意思を連結点として採用するので,契約締結地等を連結点とする客観主義に対して,主観主義と呼ばれている。この原則が近代市民法上の私的自治の原則の影響の下に発達したのは19世紀においてであるが,その萌芽は,19世紀以前のヨーロッパの学説・判例の中にも見いだすことができる。
