Substitute Prison - Daiyoukankoku

Japanese: 代用監獄 - だいようかんごく

A police detention center used in place of a prison. The Prison Law requires that prisons be used to execute sentences of imprisonment and pretrial detention, but allows detention centers at police stations to be used in place of prisons. Substitute prisons can also be used to execute sentences of imprisonment or incarceration for less than one month, but in practice they are often used to detain suspects during the investigation stage. The substitute prison system is convenient for questioning suspects, but there are strong voices calling for its abolition, as placing suspects under the control of investigative agencies leads to forced confessions and violations of defense rights, making it a breeding ground for miscarriages of justice and false accusations. However, the Criminal Detention Facility Bill (drafted by the Ministry of Justice) and the Detention Facility Bill (drafted by the National Police Agency) also allow for its continued existence.

監獄に代用された警察の留置場のこと。監獄法は，自由刑および未決勾留の執行は，監獄において行なうべきものとしつつ，警察官署に設けられた留置場を監獄に代用することを許している。代用監獄は，1月未満なら懲役，禁錮の執行にも用いることができるが，実際上捜査段階での被疑者の勾留に使用される場合が多い。代用監獄の制度は，被疑者の取り調べのためには便利であるが，被疑者を捜査機関の支配下におくことは，自白の強要や防御権の侵害に結びつき誤判・冤罪の温床になるとして廃止を求める意見も有力である。しかし，刑事施設法案 (法務省立案) および留置施設法案 (警察庁立案) においてもその存続が認められている。
