Election crime

This refers to various violations of the Public Offices Election Law that are punishable by law (Article 221 and following). Among election crimes, there are those that are substantive crimes that undermine the fairness of the public election system, such as bribery, and those that are formal crimes, such as door-to-door canvassing. There is debate over the constitutionality of the ban on door-to-door canvassing. In addition to the prescribed criminal penalties, various sanctions are imposed for election crimes, and in particular, the adoption of the civil rights suspension system and the joint liability system was aimed at regulating elections.

公職選挙法所定の各種の同法違反行為で刑罰を科せられるものをいう (221条以下) 。選挙犯罪のなかにも，買収罪のように公選制度の公正を害する実質犯的な性格のものと，戸別訪問罪のように形式犯的な性格のものがある。戸別訪問の禁止については，その合憲性をめぐって議論がある。選挙犯罪に対しては所定の刑罰以外に各種の制裁がおかれていて，特に公民権停止制度と連座制度の採用は，選挙粛正の目的をになったものである。
