Under the Civil Procedure Law, the right of questioning is the right of a party to raise an objection and contest the validity of a procedural act that violates the procedural provisions regarding the pursuit of litigation, whether or not the court or the opposing party has taken such action. In cases where the right of questioning is exercised at any time, not in cases where the procedural act violates mandatory provisions, but in cases where the procedural act violates provisions that are primarily intended to protect the interests of the parties (such as the method of filing a lawsuit, service, suspension or discontinuance of proceedings, and the method of examination of evidence), the party is allowed to waive the right of questioning, since this would impede the progress of the proceedings. Furthermore, if a party knew or should have known about the violation of the provisions but did not object without delay, the right of questioning is lost. The existence of a delay is determined by the court in each case.

民事訴訟法上，裁判所あるいは相手方によって訴訟追行に関する手続規定に違反した訴訟行為がなされた場合に，異議を述べてその効力を争うことができる当事者の権能。強行規定違反の訴訟行為ではなく，効力規定のなかでも主として当事者の利益保護のための規定 (訴え提起の方式，送達，手続の中断・中止，証拠調べの方式など) 違反の訴訟行為に関して，責問権が随時に行使されると，訴訟手続の進行を阻害するので，当事者に責問権の放棄を認める。さらに当事者が規定違反の事実を知りながら，あるいは知ることができたのに遅滞なく異議を述べなかった場合には，責問権の喪失が認められる。遅滞の有無は各場合に裁判所が判断する。
