Crime of defamation - shin'yokisonzai

Spreading false rumors or using fraudulent means to damage someone's credit is punishable by imprisonment of up to three years or a fine of up to 500,000 yen (first paragraph of Article 233 of the Penal Code). The "credit" in this crime refers to social standing in economic life, and is different from the "honor" in the crime of defamation. "False rumors" are rumors that contain false information, and "using fraudulent means" refers to deceiving or tricking others into making them mistaken. This crime does not require that these means be used to actually lower the credit of others, but it is sufficient to create a situation in which this may be the case (an abstract dangerous crime).

虚偽の風説を流布し、または偽計を用いて人の信用を毀損する罪で、3年以下の懲役または50万円以下の罰金に処せられる（刑法233条前段）。本罪の「信用」とは、経済生活における社会的評価をさし、名誉毀損罪における「名誉」とは異なる。「虚偽の風説」とは、虚偽の内容を含んだうわさのことであり、「偽計を用いる」とは、欺罔(ぎもう)（あざむきだますこと）や計略により他人を錯誤に陥らせることをいう。本罪は、これらの手段により、他人の信用を現に低下させることを要せず、そのおそれのある状態を生じさせれば足りる（抽象的危険犯）。
