Under the Civil Procedural Act, the parties and other interested parties are given the opportunity to make statements individually and freely, either in writing or orally. In cases where oral argument is not held in decision or order procedures, the court can usually hold a hearing at its discretion, but there are always cases where a hearing is required, and conversely, there are cases where a hearing should not be held. Similar actions taken by administrative agencies are also sometimes called hearings (Antimonopoly Act). 民事手続法上,書面または口頭で当事者その他の利害関係人に個々的に自由な方式で陳述の機会を与えること。決定,命令手続で口頭弁論を開かない場合には,裁判所の裁量で審尋できるのが通常であるが,常に審尋を必要とする場合があり,逆に審尋をしてはならない場合もある。また行政機関の行なう同様な行為を審尋ということがある (独占禁止法) 。
