Quasi-indictment procedure - Junkisotetsugi

This refers to the procedure in which the court, upon the request of the complainant or accuser, sends a case to trial when the prosecutor has decided not to prosecute a specific crime, such as the crime of abuse of official authority by a public official (Criminal Procedure Law, §262 et seq.). It is also called the referral procedure. It is a means of countering unjust prosecutorial decisions not to prosecute, and is a system to ensure the fairness of the prosecutor's discretion in prosecuting. There is a system of review by the Prosecutorial Review Board, which has the same purpose, but there is a big difference between the two in that the results of the review are not legally binding, whereas a decision to commence quasi-indictment procedures has the effect of indictment. In cases where a decision has been made to send the case to trial, a special prosecutor is selected from among the lawyers to pursue the case.

公務員による職権濫用罪など特定の罪につき検察官が不起訴処分をなしたことに対し，告訴人または告発人の請求に基づき，裁判所が事件を審判に付す手続をいう (刑事訴訟法 262以下) 。付審判手続ともいう。検察官の不当な不起訴処分に対する対抗手段であり検察官の訴追裁量の適正を期するための制度である。同一目的の制度として検察審査会による審査の制度があるが，その審査の結果には法的拘束力がないのに対し，準起訴手続の開始決定がなされれば，公訴提起の効力が生じる点で，両者には大きな差異がある。審判に付することが決定された事件については，弁護士のなかから特別検察官が選任され訴訟追行にあたる。
