Sovereignty debate

Japanese: 主権論争 - しゅけんろんそう

There are three sovereignty debates in modern Japanese history: (1) The debate over the concept and location of sovereignty that took place during the Freedom and People's Rights period. The issue of sovereignty came to the forefront during the movement to draft a private constitution, and in response to the publication of the theory of imperial sovereignty, such as the Kumamoto Shimei-kai Statement of Purpose in September 1881, the Tokyo Nichi Nichi Shimbun editorial "Sovereignty Theory" in January 1882, and the Constitutional Imperial Party Platform in March, the civil rights faction criticized them in newspapers and magazines, and the civil rights faction also criticized each other, leading to debate. The proponents of the Constitutional Reform Party, who supported the British-style constitutional monarchy, generally argued that "sovereignty resides between the monarch and the people," and advocated the theory of parliamentary sovereignty.

日本近代史上主権論争といわれるものとして，次の三つがある。(1)自由民権期に行われた主権の概念と所在をめぐる論争。主権問題は私擬憲法作成運動のなかで注目されるようになり，1881年9月の熊本の紫溟会主旨書，82年1月の《東京日日新聞》社説〈主権論〉，3月の立憲帝政党綱領などの天皇主権説の公表に対し，民権派が新聞･雑誌上で批判を加え，また民権派相互間でも批判しあうかたちで論争が行われた。イギリス型の立憲君主制を是とする立憲改進党系の論者は総じて〈主権は君主と人民の間にあり〉とし議会主権説などを主張。
