On-site inspection - Jikkyokenbun

Japanese: 実況見分 - じっきょうけんぶん

A discretionary measure taken by an investigative agency in the course of a criminal investigation, which involves sensing the shape of a place, object, or person (criminal investigation norms = National Public Safety Commission Regulation No. 2 of 1957). It corresponds to a compulsory inspection (Criminal Procedure Law), but since it is a discretionary measure, a warrant from a judge is not required. Case law has it that a report prepared as a result of an on-site inspection, like an inspection report prepared by an investigative agency, can be used as evidence if the preparer is questioned as a witness at the trial date and confirms that it was prepared genuinely, but this interpretation is strongly criticized in the academic world.

捜査機関が，犯罪捜査の過程で任意処分として行なう，場所，物または人についてその形状を感知することを内容とする処分 (犯罪捜査規範＝昭和 32年国家公安委員会規則第2号) 。強制処分としての検証 (刑事訴訟法) に対応するが，任意処分であるので裁判官の令状を要しない。実況見分の結果作成された調書は，捜査機関による検証調書同様，その作成者が公判期日に証人として尋問を受け，その真正な作成を確証したときは，これを証拠とすることができるというのが判例であるが，この解釈には学説上有力な批判がある。
