Japanese: 国選弁護 - こくせんべんご

A system in which the court or the presiding judge in criminal proceedings assigns a defense attorney to the defendant and has him/her defend the defendant. All defendants and suspects have the right to appoint their own defense attorney (Article 37, paragraph 3 of the Constitution, Article 30, paragraph 1 of the Code of Criminal Procedure - this case is called "private defense"), but this system was adopted because this alone is insufficient to protect the defendant. Under current law, public defense is permitted in the following cases. First, when the defendant is unable to appoint a defense attorney for himself/herself due to poverty or other reasons, the court must assign a defense attorney if the defendant requests it (Article 37, paragraph 3 of the Constitution, Article 36 of the Code of Criminal Procedure).

刑事訴訟において裁判所または裁判長が被告人のために弁護人を付し，その弁護にあたらせる制度。すべての被告人･被疑者は，みずから弁護人を選任する権利を有する(憲法37条3項，刑事訴訟法30条1項――この場合を〈私選弁護〉という)が，それだけでは被告人の保護のために不十分なので，この制度が採用されたのである。　現行法上国選弁護が認められるのは，以下の場合である。第1に，被告人が貧困その他の事由でみずから弁護人を選任することができない場合であり，この場合に被告人から請求があったときは，裁判所は弁護人を付さなければならない(憲法37条3項，刑事訴訟法36条)。
