The principle of justice is used to correct cases where the application of the law to a specific case would result in an unjust or unfair outcome. It is also said that "the law is the art of good and fairness." This principle gave rise to the concept of praetorship in contrast to civil law in ancient Rome and equity in contrast to common law in England. 具体的事件に法を適用すると実際に不当・不公平な結果になるようなとき，それを是正する原理。「法は善と衡平の術なり」ともいわれ，この原理から，古代ローマ法では市民法に対する法務官法が，イギリスではコモン・ローに対するエクイティ (衡平法 ) が生れた。
