Boundary determination suit - Kyokaikakutei no Uttae (English: Grenzscheidungsklage)

A lawsuit in which the court requests that the boundary line between adjacent lands be determined by a judgment when the boundary line is unclear. It is also called a lawsuit for determination of the boundary line. It is considered a formal lawsuit, not a confirmation lawsuit to determine the legal ownership. Since it is essentially a non-contentious case, the court is not bound by the boundary line asserted by the parties, and will always determine the boundary line that it considers to be true.

隣接する土地の境界線が不明な場合に，裁判所の判決によってその境界線を定めることを求める訴え。経界確定の訴えともいう。法律的な所有権の帰属を確定する確認訴訟ではなく，形式的形成訴訟とされている。本質上非訟事件であるから，裁判所は，当事者の主張した境界線に拘束されず，常に真実であると認める境界線を定める。
