Expectation rights - expectation rights

A right that contains the hope or expectation that if certain facts occur in the future, one will be able to receive a certain legal benefit. It is also called the right of hope. In other words, when some of the essential facts that give rise to a right have occurred but others have not yet occurred, and one has the expectation or hope that one will be able to obtain the right in the future, the protection given by law to such an expectation or expectation position is called the right of hope.

Examples of expectation rights include conditional rights, time-limited rights, and the status of a presumptive heir before the start of inheritance, each of which is given a certain level of legal protection. Regarding conditional rights, which are considered to be typical of expectation rights, the Civil Code stipulates that while it is unclear whether the condition will be met, the parties to a conditional legal act must not harm the interests of the other party that will result from the act if the condition is met (inviolability, Article 128). However, the content of legal protection for expectation rights varies depending on the content of the expectation right.

将来一定の事実が発生すれば一定の法律上の利益を受けることができるであろうという希望ないし期待を内容とする権利。希望権ともいう。すなわち、権利を発生せしめる要件事実のうち、その一部が発生し、他がまだ発生していない、という状態にあって、将来、権利を取得できるであろうという期待ないし希望をもつに至る場合、このような期待ないし期待的地位に対して、法によって与えられる保護を期待権とよんでいる。

 期待権の例としては、条件付き権利、期限付き権利、相続開始前における推定相続人の地位などがあり、それぞれ一定の法的保護が与えられている。民法は、期待権の典型とされる条件付き権利について、条件付き法律行為の各当事者は、条件の成否未定の間は、条件成就によってその行為から生じる相手方の利益を害してはならない(不可侵性、128条)と規定している。しかし、期待権に対する法的保護の内容は、期待権の内容によって異なる。
