The crime of illegally taking lost property, driftwood, or other property that has been abandoned (Criminal Code, 254). It is also called theft of abandoned property. Unlike theft of entrusted property, there is no special relationship of trust between the criminal and the owner, so in nature it is more similar to theft than to embezzlement. It is difficult to determine whether an object that has been temporarily removed from the possessor's person is abandoned, but if the person forgets about it for a moment and quickly returns to it, it is not considered lost property, but if the person leaves it there, it is considered lost property. 遺失物,漂流物その他占有を離れた他人の物を不法に領得する罪 (刑法 254) 。占有離脱物横領罪ともいう。委託物横領罪と異なり,犯人と所有者との間に特別の信頼関係が存するわけではないので,性質としては横領よりは窃盗と共通した面がある。占有者の身辺から一時的に離れた物については,占有離脱物かどうかの判断がむずかしいが,一時的に忘失してもいちはやく気づいて立戻ったような場合には遺失物といえないが,そのまま置き忘れてしまえば遺失物となる。
