… In the process of the complete revision of the Japanese Penal Code, the tentative revised Penal Code (1940) stipulated four types of security measures: custody measures, correctional measures, labor measures, and preventive measures. The revised Penal Code Draft (1974) after World War II proposed the establishment of new security measures, namely, "treatment measures" for mentally disabled criminals and "prohibition measures" for alcoholic and drug addicts. "Treatment measures" were measures that could be imposed by the court when a person who is mentally incompetent or has limited capacity to be held responsible commits an act punishable by imprisonment or more in the future, and there is a risk that if treatment and care are not provided, he or she will commit an act punishable by imprisonment or more in the future, and it is deemed necessary for security reasons (Article 98). …

…　日本の刑法全面改正作業の過程では，改正刑法仮案(1940)が，保安処分として，監護処分，矯正処分，労作処分，予防処分の4種を規定した。第2次大戦後の改正刑法草案(1974)は，保安処分として，精神障害犯罪者に対する〈治療処分〉と，アルコール･薬物中毒犯罪者に対する〈禁絶処分〉の新設を提案した。〈治療処分〉は，精神の障害のため責任無能力者または限定責任能力者である者が，禁錮以上の刑にあたる行為をした場合に，治療および看護を加えなければ将来再び禁錮以上の刑にあたる行為をするおそれがあり，保安上必要があると認められるときに，裁判所がその言渡しをすることができるというものであった(98条)。…
