Japan responded to this by promulgating the Provisional Measures Law Concerning Fisheries Zones (the so-called 200-mile Exclusive Fishing Zone Law) in May 1977, and established a 200-mile exclusive fishing zone. Through such general international practices, the ability of coastal nations to unilaterally establish 200-mile exclusive fishing zones (or economic zones) can be said to be recognized today as customary international law.

From the Japan-China Fisheries Agreement

The agreement also includes the establishment of a joint Japan-China Fisheries Council and a joint China Fisheries Association on the Chinese side. The two countries agreed to establish a joint fishing zone in the Yellow Sea, which covers the area east of the Chinese military alert line in the northern Yellow Sea and the no-fishing line for mechanized bottom trawl fishing south of that line, as well as the East China Sea and Yellow Sea areas north of the military operation line north of Taiwan. The agreement also includes the establishment of two fishing moratorium zones, four bottom trawl zones, and two purse seine zones, both of which will regulate the number of fishing vessels operating in the agreement zone, the fishing season, the mesh size, and the light power of the mechanized bottom trawl and purse seine fishing vessels. The agreement also includes the establishment of a joint Japan-China Fisheries Council and a joint China Fisheries Association on the Chinese side. …その主要な内容は,(1)協定水域は黄海北部の中国側の軍事警戒ラインおよびそれより南の機船底引網漁業禁止ライン以東,ならびに台湾北部の軍事作戦ライン以北の東海,黄海とする,(2)協定水域内外に2ヵ所の休漁区域と底引網4ヵ所,巻網2ヵ所の保護区域が設定され,協定水域の出漁漁船の機関馬力制限と保護区域は機船底引網,機船巻網各漁業別の操業隻数,漁期,網目,機船巻網の集魚灯光力などを規制する,(3)日本側の日中漁業協議会,中国側の中国漁業協会との両国民間団体の間に,安全操業,事故処理等についての民間取決めを締結し実施する,(4)漁船の海難等の緊急事態は政府援助が供与され両国の指定4港への避難が認められる,(5)日中漁業共同委員会を設置し協定の実施状況の検討が行われる,などである。77年の米ソ両国による200カイリ漁業専管水域の実施により各国も200カイリの排他的水域を設定したが,日本も77年に同様のいわゆる200海里水域法(正称は漁業水域に関する暫定措置法)を制定した(1977年5月公布,7月施行)。しかし日中両国には日中漁業協定により200カイリの排他的水域は適用されず,同年に中国の200カイリ水域内において日本は約17万tの漁獲を行ったと推定され,一定の漁業権益の確保が行われた。…
