Administrative Enforcement Act - Gyosei Daishikkouho

Law No. 43 of 1948. A general law that stipulates the grounds and procedures for substitute execution, a means of ensuring the fulfillment of obligations under administrative law. The Administrative Execution Law (Law No. 84 of 1900), which generally recognized substitute execution, execution penalties, and direct enforcement as means of administrative enforcement, was abolished by the Administrative Substitute Execution Law. The Administrative Substitute Execution Law provides that, when certain strict requirements are met for substitute actions (substitute obligation to act), after going through a warning and notification procedure, the administrative agency will either perform the act that the obligor should perform, or have a third party perform it, and collect the costs from the obligor.

昭和 23年法律 43号。行政法上の義務の履行を確保するための手段である代執行の根拠と手続を定めた一般法。行政上の強制執行の手段として代執行，執行罰および直接強制を一般的に認めた行政執行法 (明治 33年法律 84号) は行政代執行法により廃止された。行政代執行法は代替的行為 (代替的作為義務) について，一定の厳格な要件を満たしたとき，行政庁は，戒告と通知の手続を経たのち，みずから義務者のなすべき行為を行い，あるいは第三者に行わせて，その費用を義務者から徴収するとする。
