Administrative enforcement - Gyosei Daishikkou
When an administrative agency forcibly performs an administrative obligation on behalf of a person who does not fulfill the obligation. It is abbreviated as "substitute execution". This system is established by the Administrative Substitute Execution Act (Act No. 43 of 1948), and is limited to cases where there is a legal basis for the act, such as the illegal dumping of industrial waste or the illegal mooring of ships, and it is recognized that leaving the act unattended would be significantly against the public interest, and in principle, a written warning is required in advance to the obligor. In addition, the obligor is ordered to pay the costs of the substitute execution, and if they do not comply, they will be forcibly collected. On October 26, 2015, the first demolition of a vacant house by administrative substitute execution was carried out nationwide based on the Special Measures Act for Vacant House Countermeasures. In addition, at a cabinet meeting held on October 27 of the same year, the government decided to carry out procedures such as substitute execution regarding the issue of the relocation of Futenma Air Base in Okinawa to Henoko. This is the first case in which the national government will take substitute execution procedures based on the Local Autonomy Act against the statutory entrustment of a local government.

行政的な義務を履行しない者の代わりに、行政機関が強制的にその行為を行うこと。「代執行」と略称される。行政代執行法(昭和23年法律43号)により定められている制度で、産業廃棄物の不法投棄や船の不法係留など、法令的に根拠があり放置しておくと著しく公益に反すると認められる場合に限られ、原則として事前に義務者への文書による戒告が義務づけられている。また、代執行に要した費用の支払いは義務者に命じられ、応じない場合強制的に徴収される。2015年10月26日より、空き家対策の特措法に基づき全国で初めて行政代執行による空き家の取り壊し作業が行われた。また同年10月27日に行われた閣議で政府は、沖縄・普天間飛行場の辺野古移設問題につき、代執行等の手続きを行うことを決定した。これは国が地方公共団体の法定受託事務に対し、地方自治法に基づく代執行手続きを取る初のケースとなる。
