A license that is granted (compulsorily) regardless of the will of the patent owner. All compulsory licenses provided for in Japan's Patent Law have the nature of a non-exclusive license, and a person seeking the grant of a license may request a compulsory license from the Commissioner of the Japan Patent Office (or the Minister of Economy, Trade and Industry) in the following cases: (1) When the patent owner has not worked the patented invention for more than three years. (2) When the patent owner cannot work his/her own patented invention without using another person's patented invention. (3) When it is necessary for the public interest. 特許権者の意思を無視して (強制的に) 設定する実施権。日本の特許法の定める強制実施権はいずれも通常実施権の性質を有し,実施権の設定を求める者は次の場合に特許庁長官 (または経済産業大臣) に裁定の請求をすることができる。 (1) 特許権者が特許発明を3年以上実施していないとき。 (2) 他人の特許発明を利用しないと自分の特許発明を実施することができないとき。 (3) 公共の利益のために必要なとき。裁定実施権ともいう。 (→通常実施権 )
