...However, the subsequent purge of a Minister of State from public office during the Occupation triggered debate over the nature of litigation procedures for administrative cases. As a result, since administrative cases are legal disputes between administrative bodies such as the state and local governments and the public, it was thought that it was not necessarily appropriate to handle them in the same manner as general civil cases, which are disputes between private individuals. For administrative cases, the Special Act on Administrative Litigation was enacted in 1948, followed by the current Administrative Litigation Act in 1962.
[Current system]
Compared to the prewar administrative court system, the current administrative litigation system has seen significant improvements, such as the adoption of a three-tiered trial system similar to that for civil and criminal cases, and the adoption of a general generalization principle for the matters to be prosecuted. On the other hand, however, there are still some issues, such as the elimination of provisional measures under the Civil Preservation Act (Article 44 of the Administrative Litigation Act) and the principle of non-suspension of execution (Article 25, Paragraph 1.
