Instigation - Kyousa

Japanese: 教唆 - きょうさ

Instigating another person to make the decision to commit a crime. A form of complicity. If the instigated person makes the decision and carries out the crime as a result of instigation, he/she will be punished as an instigator in the same manner as the principal offender (Article 61 of the Penal Code). The method of instigation can be explicit or implicit, direct or indirect. The Subversive Activities Prevention Act and Special Criminal Acts punish instigation as an independent crime, without waiting for the instigated person to carry out the crime.

他人をそそのかして犯罪実行の決意を起こさせること。共犯の一形式。教唆した結果，被教唆者が決意・実行したときは教唆犯として正犯に準じて処罰（刑法61条）。教唆方法は明示・黙示，直接・間接を問わない。破壊活動防止法，刑事特別法などは被教唆者の実行をまたず，教唆を独立犯として処罰。
