Common benefit claim

In corporate reorganization procedures, these are claims that arise based on common causes among the parties involved and therefore are treated differently from reorganization claims. They correspond to estate claims under the Bankruptcy Act (Bankruptcy Act). In principle, reorganization claims and secured reorganization rights that arose based on causes before the start of reorganization procedures can only be paid through reorganization procedures, whereas common benefit claims are claims that arose based on common causes after the start of reorganization procedures and are paid as they arise (Corporate Reorganization Act). Common benefit creditors can enforce enforcement against company assets based on common benefit claims.

会社更生手続き上，関係人の共益的原因に基づいて生じたことから，更生債権と異なった特別の取り扱いを受ける債権。破産法上の財団債権 (破産法) に相当する。更生手続開始前の原因に基づいて生じた更生債権，更生担保権は原則として更生手続によらなければ弁済を受けることができないのに対し，共益債権は更生手続開始後に共益的な原因に基づいて生じた債権として，その都度弁済される (会社更生法) 。共益債権者は会社財産に対し，共益債権に基づき強制執行などをすることができる。
