A theory that holds that the purpose of punishment is to educate criminals so that they can reintegrate into society. It is one of the theories of purposive punishment as opposed to retributive punishment. It is an argument of the new school of criminal law. Purposive punishment theory takes the position that the essence of punishment is its own purpose, and is relativist in that it considers punishment to be a means to an end. Educational punishment theory takes the special prevention theory as the purpose of punishment, and seeks to educate criminals to improve their bad character by imposing punishment, so that they will not commit crimes again. To achieve this educational purpose, it is necessary to respond to the individuality of the prisoner (principle of individualization of punishment) and to have an indefinite sentence. →Makino Eiichi / Ferri / List Source : Heibonsha Encyclopedia About MyPedia Information |
