When a lawsuit for performance is filed, a judgment on the merits recognizes the existence of the claim for performance asserted by the plaintiff and orders the defendant to perform (or refrain from performing) that performance. Unlike a declaratory judgment or formative judgment, only a performance judgment has the force of execution and becomes a title of debt.
