Old Commercial Code

Japanese: 旧商法 - きゅうしょうほう

The Commercial Code, consisting of 3 volumes and 1064 articles, was based on a draft by H. Roessler, a foreign employee, and was promulgated in April 1890 as Law No. 32 of the 23rd year of the Meiji era, and was set to come into effect on January 1 of the following year. After its promulgation, it was criticized by both the government and the opposition, and its implementation was postponed along with that of the Civil Code (→ Civil Code Controversy). Some provisions were subsequently amended, but when the Commercial Code (also known as the Meiji Commercial Code) came into effect in 1899, all provisions except for the Bankruptcy Law were abolished.

全3編 1064条，御雇外国人 H.ロエスレルの草案をもとにし，1890年4月，明治 23年法律 32号として公布され，翌年1月1日施行と定められていた商法。公布後，朝野に批判が起り，民法とともに，施行が延期された (→民法典論争 ) 。その後，一部が修正施行されたが，99年商法 (いわゆる明治商法) 施行と同時に，破産法を除く全規定が廃止された。
