Management act - Kanrikōi

It refers to acts of preserving property and making it suitable for its economic use, i.e., acts of preservation (acts to maintain the value of property in its current state) and acts aimed at utilizing or improving the property without changing its nature. As opposed to acts of disposal. Management acts are often used to determine the scope of authority of administrators (Civil Code Articles 28, 103, 918, paragraph 3, and 953, etc.). The term management acts is legally used as a general term for the following acts: (1) acts of preservation (acts to maintain the current state of the property that is the subject of the agency, such as entering into a contract for repairing a house), (2) acts of utilization (acts to make a profit without changing the nature of a property, for the purpose of agency, such as renting a house), and (3) acts of improvement (acts to increase the economic value of a property without changing its nature, such as entering into a contract for land leveling for a housing site or changing an interest-free loan to an interest-bearing one, for the purpose of agency).

財産を保管してその経済上の用途に適させるような行為、すなわち、保存行為(財産の価値を現状において維持するための行為)、および財産の性質を変更しない範囲で利用または改良を目的とする行為をいう。処分行為に対する。管理行為は、管理人などの権限の範囲を定めるのにしばしば用いられる(民法28条・103条・918条3項・953条など)。管理行為ということばは法律上、次のような行為の総称として用いられる。すなわち、(1)保存行為(代理の目的となっている財産の現状を維持するための行為、たとえば家屋修理のため請負契約を結ぶなど)、(2)利用行為(代理の目的で、ある財産の性質を変更しない範囲で収益を図る行為、たとえば家屋を賃貸するなど)、(3)改良行為(代理の目的で、ある財産の性質を変更しない範囲でその経済的価値を増加するような行為、たとえば宅地の地ならしのための請負契約を結ぶとか、無利息の貸金を利息付きに改めるなど)の行為である。
