The term administrative discretion is used in the sense of legislative discretion (discretion exercised by legislative power) and judicial discretion (discretion exercised by judicial power), but the theory of discretion in modern states is mainly concerned with administrative discretion, and therefore administrative discretion is sometimes simply referred to as discretion. Administrative discretion is exercised in all aspects of the series of activities of administrative agencies, that is, the administrative process, and its areas of application include administrative legislation such as national cabinet orders and ministerial ordinances or local government ordinances and regulations, as well as administrative plans, administrative dispositions, administrative guidance, administrative enforcement, and private economic actions such as contracts between the state or local government and private individuals (contracts under public law and private law). ...
