The judicial mediation system in the early Meiji period. In the Edo period, reconciliation was called naisei, and the courts encouraged the parties to do so. The Meiji government also inherited this tradition, establishing a system of kansai in 1875, and in 1881 making it compulsory to settle cases before they could be settled. In 1884, following the French system, the government established the Rules for the Promotion of Reconciliation, setting up kansai kakari in peace courts to exclusively settle cases, but the Civil Procedure Code promulgated in 1890 did not adopt the principle of reconciliation before a lawsuit was filed. 明治初期における裁判上の調停制度。江戸時代には和解のことを内済といい,裁判所はこれを当事者に勧奨したが,明治政府もこの伝統を受け継ぎ,1875年に勧解の制度を設け,1881年には強制的に和解前置主義をとった。 1884年にフランスの制度にならい勧解略則を設けて治安裁判所には勧解掛をおき,もっぱら訴訟事件の勧解をさせていたが,1890年公布の民事訴訟法では訴えの提起に和解前置主義をとっていない。
